  1. Crimes committed by a regulated entity against a consumer, i.e. fraud, embezzlement, exploitation, etc.
  2. Crimes committed by a consumer against an insurance company, i.e. fraudulent insurance claims, insurance fraud
The Anti-Fraud Unit’s Primary Mission is:

The investigation of regulated entities accused of violating administrative and/or criminal law.

The Anti-Fraud Unit can assist other Law Enforcement agencies with:
  1. The local investigation of insurance fraud committed against an insurance company
  2. The referral of local insurance fraud complaints to the Attorney General’s Insurance Fraud Unit
The Oklahoma Insurance Department approves, licenses and regulates:

Domestic and Foreign Insurance Companies; Accredited Reinsurance Companies; Captive and Independent Insurance Agents; Claims Adjustors and Public Adjusters; Health Maintenance Organizations; Dental Organizations; Pre-Paid Funeral Trusts; Cemetery Merchandise Trusts; Charitable Annuity Trusts; Surplus Lines Companies, Risk Retention Groups; Risk Purchasing Groups; Third Party Administrators; Professional Employer Organizations; Pharmaceutical Benefit Managers; Motor Service Clubs; Service Warranty Companies; Title Insurance Companies; Bail Bondsmen and Professional Bail Bondsmen; and Real Estate Appraisers.

Oklahoma Criminal Statute for “Insurance Fraud” (Title 21):
§ 1662. Fraudulent Claim Upon Insurance Contract for Payment of Loss
Any person who presents or causes to be presented any false or fraudulent claim, or any proof in support of any such claim, upon any contract of insurance, for the payment of any loss, or who prepares, makes or subscribes any account, certificate, survey affidavit, proof of loss, or other book, paper or writing, with intent to present or use the same, or to allow it to be presented or used in support of any such claim, shall be guilty of a felony punishable by imprisonment in the State Penitentiary not exceeding three (3) years, or by a fine not exceeding twice the amount of the aggregated loss sum, or both.

Oklahoma Statute of Limitations for “Insurance Fraud” (Title 22):
§ 152. Limitations in General
E. Prosecutions for the crime of criminal fraud or workers’ compensation fraud pursuant to Section 1541.1, 1541.2, 1662 or 1663 of Title 21 of the Oklahoma Statutes shall commence within three (3) years after the discovery of the crime, but in no event greater than seven (7) years after the commission of the crime.

While NCIC is the standard law enforcement database for stolen vehicles, NICB’s VINCheck is a free service provided to the public to assist in determining if a vehicle has been reported as stolen, but not recovered. An additional benefit for the investigator is that it also queries VINs reported as salvage vehicles by cooperating NICB member insurance companies. To perform a search, a vehicle identification number (VIN) is required. A maximum of five searches can be conducted within a 24-hour period per IP address.

The Anti-Fraud Unit can also assist local Law Enforcement with:
  1. Claims database searches to assist local departments with an insurance fraud investigation
  2. Administrative subpoena of claim information needed for an insurance fraud investigation
  3. Requests for on-site CLEET accredited training in conducting insurance fraud investigations
  4. Speaking engagements on fraud-related topics for local organizations or community events
  5. Inquiries regarding security verifications, uninsured motorists, or any aspect of insurance law
